East Santa Rosa Neighbors appeal Skyhawk case to Supreme Court

In July of 2005, East Santa Rosa Neighbors sued to stop the final two phases of the Skyhawk development in east Santa Rosa involving 35 luxury homes and a secondary access road.
The lawsuit against the city of Santa Rosa challenged the approval of a secondary access road that would cut through an unincorporated area. It demanded a new Environmental Impact Report and argued that the city was in violation of both the Williamson Act and the California Environmental Quality Act.
When the group lost that case in August of 2006, it appealed. The city of Santa Rosa won that appeal last month and the neighbors had until today to petition to the California Supreme Court.
Regarding the decision to petition to the Supreme Court, Fred Greenstein of the East Santa Rosa Neighbors said, “We felt like justice was not served at the Superior Court and Court of Appeal.”
Christopherson Homes representatives could not be reached for comment.
